Terms of Service

By creating an account or using Kalagen AI ("the Service"), you agree to these Terms of Service. If you do not agree, do not use the Service. These terms constitute a binding agreement between you and Kalagen AI Technologies Pvt. Ltd. ("Kalagen AI", "we", "us").

You must provide accurate, complete information when creating an account. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You must be at least 13 years old to use the Service. Accounts are non-transferable. If you suspect unauthorised access to your account, notify us immediately at support@kalagen.ai.

Credits are the in-platform currency used to generate images and videos. Credits are purchased in packs and are non-transferable between accounts. Credits do not expire and have no cash value. All payments are processed securely by Razorpay. By purchasing credits, you authorise Razorpay to charge your chosen payment method. Prices are displayed in Indian Rupees (INR) inclusive of applicable taxes. We reserve the right to modify credit pricing with reasonable notice.

You agree NOT to use Kalagen AI to generate: • Content that is sexually explicit, pornographic, or involves minors • Content that promotes violence, terrorism, or hate against individuals or groups • Content that defames, harasses, or impersonates real individuals • Content that infringes third-party intellectual property rights • Deepfakes or misleading content intended to deceive or defraud Violations may result in immediate account suspension without refund. We reserve the right to review generated content for policy compliance.

Subject to these Terms, you own the images you generate using Kalagen AI and may use them for personal and commercial purposes, including advertising, social media, print, and merchandise. Kalagen AI retains ownership of its platform, proprietary AI models, Indian Cultural Intelligence pipeline, brand assets, and all underlying technology. You may not reverse-engineer, copy, or resell any part of the platform.

You are solely responsible for the prompts you submit and the content generated. Kalagen AI acts as a tool; the output depends on your inputs. You must ensure your use of generated images complies with applicable Indian and international laws. Kalagen AI provides images on an "as is" basis and makes no warranties about the accuracy, cultural completeness, or fitness for any specific commercial purpose of generated images.

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED BY LAW, KALAGEN AI SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES ARISING FROM YOUR USE OF THE SERVICE. Our total liability to you for any claims arising from these Terms shall not exceed the amount you paid for credits in the 3 months preceding the claim.

We may suspend or terminate your account at any time for violation of these Terms, suspected fraud, or any other reason at our discretion. You may delete your account at any time via Settings. Upon termination, your access to the Service ends immediately. Credits in your account at time of termination are forfeited unless termination was caused by our error.

We may update these Terms at any time. For material changes, we will provide at least 7 days' notice via email or in-app notification. Continued use of the Service after the effective date constitutes acceptance of the updated Terms.

These Terms are governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the courts of Mumbai, Maharashtra, India.
